Third Party Funding and Mediation

SCCM - Practice Group B2B

Third party funders support parties in pursuit of strong arbitration or litigation claims by providing financial support, typically including paying some or all of the attorneys fees, expenses and court costs. Such funding is “non-recourse”: If the claim is not successful, the funder receives nothing in return for its investment. If the claim is successful, the funder receives a portion of the resulting proceeds. Numerous questions have arisen in connection with third party funding and mediation, including the following:

•	Third party funders have been accused of being anti-mediation. Is this true?
•	Are third party funders interested in investing in mediation?
•	Can concepts developed in third party funding of arbitration and court cases be applied in other ways to support resolution of disputes through mediation?

Mediators Jeremy Lack and Kirstin Dodge (who is also Head of the Americas and Southern Europe for the Swiss third party funder Nivalion) will address these questions and more.
