Why do we need commercial mediation?

The Swiss Arbitration Association (ASA) and the Swiss Chamber of Commercial Mediation (SCCM) are jointly organizing this Webinar Series to provide practical tips for inhouse counsel, arbitration practitioners, lawyers and mediators.

Last year we discussed whether mediation even works with regard to commercial disputes. As we concluded in the affirmative, we would now like to continue our discussion and raise the fundamental question of "why do we need commercial mediation?" Or in other words, in what situations does it make sense to mediate and why isn't mediation used more often – given its unique features such as procedural flexibility, the ability to overcome negotiation deadlocks and to agree on a settlement within a one or two day session and, last but not least, its relative risk-free character compared to adjudicative processes?

The discussion will be followed by a Q&A session.
